Aspek Hukum Surrogate Mother (Sewa Rahim) Dalam Perspektif Hukum Indonesia

Surrogate Mother adalah seorang wanita yang mengandung anak yang benihnya berasal dari pasangan lain dan setelah wanita tersebut melahirkan, maka wanita tersebut akan memberikan anak tersebut kepada pasangan darimana benih tersebut berasal. Status hukum anak yang lahir dari surrogate mother mempunyai kemungkinan yang unik terkait dengan siapa yang disebut sebagai orang tua. Dalam tradisional Surrogacy maka yang menjadi ayah dan ibu biologisnya adalah laki-laki yang memberikan sperma dan surrogate mother darimana ovum itu berasal. Tujuan khusus yang ingin dicapai dengan dilakukannya penelitian ini, adalah untuk memahami dan mengkaji kedudukan surrogacy Agreement menurut Hukum Perjanjian di Indonesia, memahami dan mengkaji status hukum anak yang lahir dari Surrogate Mother, pengaturan pelaksanaan Surrogate Mother di beberapa negara sebagai perbandingan dan untuk memahami dan mengkaji bagaimana sebaiknya pengaturan Surrogate Mother di Indonesia. Hasil dari penelitian ini yang pertama Indonesia belum memiliki aturan yang spesifik mengatur mengenai Surrogate Mother, oleh karena itu pelaksanaan Surrogate mother yang terkait dengan perjanjian surrogacy tidak dimungkinkan dilakukan di wilayah hukum Indonesia., Status anak yang lahir dari surrogate mother dalam kaitan dengan pengaturan Undang-undang No. 1 Tahun 1974 tentang Perkawinan, bahwa anak tersebut merupakan anak sah dari Surrogate Mother, bukan anak dari Orang tua yang menitipkan benih di rahim surrogate mother.Telah dilakukan perbandingan dengan beberapa Negara seperti Singapura dan India, dari hasil penelurusan data disimpulkan bahwa terdapat Negara-negara yang menolak dan terdapat pula Negara-negara yang dapat menerima keberadaan surrogate mother, Sehubungan dengan banyaknya praktik yang dilakukan oleh masyarakat terkait dengan surrogate mother, kami merasa perlu dibuat aturan yang akan berperan sebagai panduan dalam pelaksanaan surrogate mother yang dimaksudkan untuk adanya ketertiban dan kepastian hukum.

Surrogate mother is defined as woman carrying another person’s embryo and gives birth to a baby for the person who donors the embryo. The unique characteristic arises from who will be called as the parent. In traditional surrogacy, the biological parent is the father who donor the sperm and the surrogate mother. Surrogate mother exists because the wife usually obtain something wrong in her uterus thus cannot carrying a child, subsequently the role of the wife to carry and give birth is transferred to another woman, either voluntarily or because of the money. The essence and substance of surrogacy, which was constructed as an alternative of medical disorder (genetical disability or illness), has then shifted into commercialization of a person’s uterus. The intended parents are no longer aim for medical purpose, rather, for cosmetic and estetic reasons; while the surrogate mother has made it into a new way to make a living (especially in lower economic society), such as India, Bangladesh and China. The local government even facilitate this by building a centre of uterus renting, including managing their visa and medical visa. The purpose of this research is to comprehend and analyse the status of surrogacy agreement in Indonesian contract law; the status of child born through surrogacy; the regulations regarding surrogate mother implemented in several countries as comparison; lastly, to formulate a suitable regulation of surrogate mother in Indonesia. The results of the research are, first, Indonesia do not have specific regulations regarding surrogate mother, thus surrogacy can not be implemented in Indonesia. Second, in relation with Law Number 1 of 1974 concerning marriage, the status of child born through surrogacy is the legitimate child of the surrogate mother, not the intended parent. Third, as a result of comparison with several countries, for example, Singapore and India, many countries reject and many also accept the existence of surrogate mother. Lastly, due to rampant practice of surrogacy in the society, the writer concludes the government need to promptly draft a regulation as a guidance of surrogacy practice to maintain order and legal certainty in the society.
