Kedudukan Komisi Independen Sebagai State Auxiliary Institutions Dan Relevansinya Dalam Struktur Ketatanegaraan Indonesia

In the modern states, societies demand the governments to be more effective and efficient in the exercise of their functions as the public service providers. So, states create various states’ auxiliary organs as the additions, assistances or supporting institutions to the governments. Indonesia is considered to have various forms of institutions of this kind. The legal bases of the establishments of these institutions are different and ambiguous, especially related to their independence status. The aim in establishing these institutions are different, due to different problems, but the facts so far have proven that there have been frictions between the related institutions. It is important to investigate the grand design of the Indonesian government institutions to determine the position of the state auxiliary institutions. The position of the states auxiliary institutions in the whole governmental structure in Indonesia is in between the governmental political sphere (supra-structure) in the upper side and the socio-political sphere (infra-structure) in the lower side. This position reflects the main objective of their establishments to make bridging tools between the power of the societies and the power of the governments. These independent institutions are not totally separated from the main governmental institutions. The positions of the state auxiliary institutions which have not had clear independences become ambiguous in the whole governmental structure. This fact causes the current development of these institutions in Indonesia become irrelevant with their roles in the governmental structure.
