Abstrak

Praktik Perceraian Pada Keluarga Rote Thie Di Desa Tanah Merah, Kupang – Ntt (Divorce Practices On Rote Thie Families In Tanah Merah Village, Kupang – Ntt)

Penelitian ini bertolak dari fenomena tentang Praktik Perceraian yang sering dilakukan oleh Keluarga Rote Thie di Tanah Merah dalam hukum Adatnya yang tidak mempermudah bahkan hukum Agama Kristen Protestan (yang dianut) yang melarangnya. Terkesan perceraian sebagai penyimpangan namun terus terjadi sehingga membutuhakan penjelasannya. Demikianlah tujuan penelitian ini adalah : 1) Mendeskripsikan eksistensi praktik perceraian. 2) Menemukan rasionalisasi dari praktik perceraian. Penelitian ini menggunakan metode kualitatif yang antara lain bertujuan memahami proses sosial dari realitas tertentu. Alasan menggunakannya karena yang akan dikaji adalah proses sosial dari praktik perceraian yaitu untuk menemukan gambaran yang relatif holistik tentang realita itu. Informan dari penelitian ini adalah pelaku perceraian, keluarga utuh sebagai kelompok kontrol, tokoh-tokoh adat, tokoh agama dan Pemerintah Desa. Mereka dipandang tepat sebagai sumber data yang dapat memberi informasi yang relatif lengkap sesuai tujuan penelitian. Penentuan informan adalah menggunakan teknik Snowball. Keakuratan data diperoleh dengan menggunakan metode triangulasi, yaitu menyangkut triangulasi metode dan sumber data. Pengumpulan data dilakukan dengan teknik wawancara mendalam, observasi dan menggunakan data sekunder. Dalam keadaan terbatas, akan digunakan juga analisa deskriptif kuantitatif. Hasil penelitian menunjukkan : Perceraian terjadi sebagai akibat anomi, yaitu karena adanya ketidaksesuaian antara tujuan perkawinan dan alat institusional untuk mencapai tujuan tersebut. Perceraian sebagai penyimpangan yang fungsional terhadap upaya menemukan kebahagiaan perkawinan. Perceraian mempunyai fungsi manifest sebagai solusi konflik dalam berkeluarga; sedangkan fungsi latennya adalah sebagai saluran sosial dalam upaya menemukan kebahagiaan berkeluarga.

The research based on the phenomenon recently regarding the divorce cases which had happened in the traditional wisdom law of Rote Thie families in Tanah Merah. The divorce cases are uneasy procedures even forbidden circumstance under the Protestant principle. It seems that the divorce cases are “the anomaly” social case in the community, and for that reason, the research has aims to: 1) describe the existence of divorce cases; 2) figure out the rational reason on the divorce cases. The research applied qualitative method, which aims to get better understanding and knowledge about social process of the certain reality condition. The assessment on the social process of the certain reality condition is to find out the clear description and get the “whole pictures” about the reality of life itself. The informant of the research are the perpetrator; the doer/person responsible for the divorce, and the steady family as the control group, besides the leader of the community, leader of the religion, and the Local Government officers. All the subjects are the right sources to provide the correct information and data which are needed for the research. The informant is decided by Snowball technique. The accurate data is collected by triangulation method, both for the data sources and the method of the research. Data collected by in-depth interview method, observation and secondary data application. In a particular case, the research will apply quantitative descriptive analysis. The results of the research are showed that the existence of divorce cases caused by “anomie”—the discrepancy between the goal of the marriage and institutional tools to achieve the above-mentioned aims. The divorce considers as the functional disorientation against the efforts to finding the happiness marriage. The divorce has manifest function for the conflict resolution in the family, while the latent function is as the social media for finding out the value of “happy family”.
