The notary in Indonesia is a particular position appointed and dismissed by the Government, represented by the Ministry of Justice and Human Rights, to carry out the legal profession and serving the community. One of the authority held by a notary, as stipulated in laws and regulations, is the establishment of a Limited Company. In connection with such authority this paper will examine: To what extent are the authority possessed by a notary in the establishment of a Limited Company On the establishment of a limited company, the role of a notary begins when he/she prepares the mandatory articles of association of the limited company rendered in a notarial deed. The role of a notary continues to the extent of registering a request to validate the company as a legal entity, and being the founder’s proxy the empowered notary has the quality and capacity to formally and legitimately register the request. Ultimately a notary is the only public officials entitled to prepare authentic deed as a perfect instrument of evidence, appointed by the Government with vast authority in the process of establishing a Limited Company, beginning from the establishment up to the extent of obtaining the legal status of the Limited Company.
